Reminder to Register Chemicals under REACH; ECHA Launches New Web Site to Help

On April 14, the European Chemicals Agency (ECHA) revealed a new web site for companies seeking to undertake pre-registration under REACH, which requires that chemical substances on their own, in preparations (mixtures, like paints) and those that are intentionally released from articles, have to be registered with ECHA.

Maryland House Judiciary Committee Gives Market Share Liability Bill Unfavorable Report

On March 18, the Judiciary Committee of the Maryland House of Delegates voted down 10-6 the Maryland State and Children's Lead Poisoning Recovery Act, which would establish risk contribution or market share liability as a legally recognized theory of liability for lead poisoning cases and eliminating the requirement that a person prove that a manufacturer manufactured the lead pigment contained in a certain lead-based paint that caused the damage to establish liability.

The Consumer Product Safety Commission (CPSC) Reform Act, or S. 2663, passed the Senate on March 6 by a vote of 79-13.

Senate Passes CPSC Reform Act; Lead Levels in Paint Reduced to 90 ppm

The Consumer Product Safety Commission (CPSC) Reform Act (S. 2663) passed the Senate on March 6 by a vote of 79 to 13. A provision in S. 2663 seeks to reduce residual lead levels in consumer paints from 600 parts per million (ppm) to 90 ppm within one year after enactment. The House version would reduce levels from 600 ppm to 90 ppm within 180 days after enactment.

House Homeland Security Committee Approves Chemical Security Legislation

The House Homeland Security Committee on March 6 approved draft legislation that would extend and modify federal authority to regulate the security of U.S. chemical plant – a measure that among other things would require chemical plants to consider use of "inherently safer technology (IST).”
